{"id":2635,"date":"2016-10-14T08:33:42","date_gmt":"2016-10-14T12:33:42","guid":{"rendered":"http:\/\/dankrell.com\/blog\/?p=2635"},"modified":"2019-07-13T09:47:51","modified_gmt":"2019-07-13T13:47:51","slug":"liberty-housing-private-citizens","status":"publish","type":"post","link":"https:\/\/dankrell.com\/blog\/2016\/10\/14\/liberty-housing-private-citizens\/","title":{"rendered":"Liberty, housing, private citizens"},"content":{"rendered":"\n<p>Since its inception, the <a href=\"http:\/\/www.consumerfinance.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Consumer Financial Protection Bureau<\/a> (consumerfinance.gov) has had many advocates and many critics.&nbsp; While many point to the CFPB\u2019s staunch protection of consumers, some have argued that the independent agency has too much power with little oversight.&nbsp; And this week\u2019s opinion from the United States Court of Appeals in the case of <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/AAC6BFFC4C42614C852580490053C38B\/$file\/15-1177-1640101.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">PHH Corp v. Consumer Financial Protection Bureau <\/a>seems to side with CFPB\u2019s detractors &#8211; and highlights liberty, housing, private citizens.<\/p>\n\n\n\n<p>As you know, <a rel=\"noopener noreferrer\" href=\"http:\/\/dankrell.com\/blog\/2011\/09\/15\/a-novel-idea-consumer-friendly-mortgage-disclosure\/\" target=\"_blank\">the CFPB was created <\/a>in the aftermath of the financial crisis by the passing of Dodd-Frank in 2010.\u00a0 Dodd-Frank (also known as the Dodd\u2013Frank Wall Street Reform and Consumer Protection Act) came at a time when politicians wanted to reign in financial institutions and businesses.\u00a0 In order to carry out financial reform, Dodd-Frank created a number of oversight boards and agencies in an expansive piece of legislation that covered many areas spelled out in over 2,000 pages.\u00a0 And even in its behemoth size, Dodd-Frank left much of the reform regulations to be written by agencies and its unelected officials &#8211; including the CFPB.<\/p>\n\n\n\n<p>The CFPB has issued many new rules and have fined many banks and lenders.&nbsp; Some of the new rules have fundamentally changed the relationship between the consumer and the bank.&nbsp; For example, the TRID (<a href=\"http:\/\/dankrell.com\/blog\/2015\/09\/10\/trid-implementation-remakes-the-home-buying-process\/\" target=\"_blank\" rel=\"noopener noreferrer\">TILA-RESPA Integrated Disclosure<\/a>) rule that went into effect this year which not only changed how settlements are conducted but can levy stiff a penalty for each violation.<\/p>\n\n\n\n<p>The case PHH Corp v. Consumer Financial Protection Bureau, appeared as if a seemingly \u201cbad\u201d mortgage lender was pushing back against fines and penalties for doing wrong.&nbsp; (PHH Corp was fined $108 million by the CFPB for mortgage re-insurance deals with company affiliates, even though it claimed to have followed HUD\u2019s previous rule of paying a reasonable market rate.)&nbsp; But there\u2019s more to this story, and it highlights exactly the what the CFPB\u2019s critics have complained about \u2013 the CFPB\u2019s independence from oversight and guidance.&nbsp; The case is about the CFPB\u2019s authority to change the rule and retroactively apply it to PHH Corp.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Judge Kavanaugh wrote: \u201c<strong><em>This is a case about executive power and individual liberty. The U.S. Government\u2019s executive power to enforce federal law against private citizens \u2013 for example, to bring criminal prosecutions and civil enforcement actions \u2013 is essential to societal order and progress, but simultaneously a grave threat to individual liberty<\/em><\/strong>.\u201d<\/h3>\n\n\n\n<p>He continued to say that \u201c\u2026<em>the Director of the CFPB possesses enormous power over American business, American consumers, and the overall U.S. economy. The Director unilaterally enforces 19 federal consumer protection statutes, covering everything from home finance to student loans to credit cards to banking practices.
