{"id":2680,"date":"2016-11-17T20:10:27","date_gmt":"2016-11-18T00:10:27","guid":{"rendered":"http:\/\/dankrell.com\/blog\/?p=2680"},"modified":"2021-11-23T16:45:47","modified_gmt":"2021-11-23T21:45:47","slug":"its-mr-trumps-housing-market-now","status":"publish","type":"post","link":"https:\/\/dankrell.com\/blog\/2016\/11\/17\/its-mr-trumps-housing-market-now\/","title":{"rendered":"It&#8217;s Mr. Trump&#8217;s housing market now"},"content":{"rendered":"<figure style=\"width: 400px\" class=\"wp-caption alignright\"><a href=\"https:\/\/web.archive.org\/web\/20171209172338\/https:\/\/www.uschamber.com\/above-the-fold\/dodd-frank-s-regulatory-nightmare-one-rather-mesmerizing-illustration\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full\" src=\"https:\/\/i0.wp.com\/www.uschamber.com\/sites\/default\/files\/ill-df_0.jpg?resize=400%2C500&#038;ssl=1\" alt=\"Trump's housing market\" width=\"400\" height=\"500\" \/><\/a><figcaption class=\"wp-caption-text\">Dodd-Frank regulation (from uschamber.com)<\/figcaption><\/figure>\n<p>Change is not always easy.\u00a0 Sometimes we choose to change and other times we are forced to change.\u00a0 The Great Recession forced massive change to many aspects of our lives \u2013 mostly financial.\u00a0 Many found themselves out of work because of the recession, and many home owners lost their homes to foreclosure; while the rest of us searched for ways to cope.\u00a0 <span style=\"color: #ffffff;\">It&#8217;s Mr. Trump&#8217;s housing market now.<\/span><\/p>\n<p>As a result, the <a href=\"https:\/\/dankrell.com\/blog\/2011\/12\/27\/real-estate-in-review-2011\/\" target=\"_blank\" rel=\"noopener noreferrer\">Dodd\u2013Frank Wall Street Reform and Consumer Protection Act<\/a> was quickly pieced together and signed into law in 2010.\u00a0 \u201cDodd-Frank\u201d, contained over two-thousand pages of regulations and rules, many of which were to be created at a later time by many agencies and unelected bureaucrats.\u00a0 Dodd-Frank also created the Consumer Financial Protection Bureau, which took over RESPA, lending and consumer finance markets enforcement responsibilities.\u00a0 The CFPB created the \u201c<a href=\"http:\/\/dankrell.com\/blog\/2011\/04\/27\/what%e2%80%99s-the-big-deal-about-the-qualified-residential-mortgage-anyway\/\" target=\"_blank\" rel=\"noopener noreferrer\">Qualified Residential Mortgage<\/a>\u201d and \u201c<a href=\"http:\/\/dankrell.com\/blog\/2015\/09\/10\/trid-implementation-remakes-the-home-buying-process\/\" target=\"_blank\" rel=\"noopener noreferrer\">Know Before You Owe<\/a>\u201d rules that significantly impacted the mortgage and housing industries.<\/p>\n<p>The purpose of <a href=\"http:\/\/live.blogs.realtor.org\/2011\/05\/13\/640\/\" target=\"_blank\" rel=\"noopener noreferrer\">Dodd-Frank<\/a> and the CFPB was well intentioned as Congress sought a solution to prohibit future crises.\u00a0 In the uncertain financial atmosphere that ensued, consumers wanted accountability from Wall Street and mortgage lenders.\u00a0 While some continue to generally blame Wall Street and the mortgage industry for the financial crisis, the reality is that the dynamics that created the financial crises were complex.\u00a0 And one can surmise from the many hearings, books, dissertations, and working papers that <a href=\"http:\/\/dankrell.com\/blog\/2013\/09\/18\/five-years-ago-was-real-estate-to-blame-for-financial-crisis\/\" target=\"_blank\" rel=\"noopener noreferrer\">the crux of the financial crisis<\/a> was widespread fraud that took advantage of a hot real estate market and easy money.<\/p>\n<p>Six years after Dodd-Frank, the rules and regulations keep coming.\u00a0 Writing for the US Chamber of Commerce\u2019s \u201cAbove the Fold,\u201d J.D. Harrison pointed out that Dodd-Frank has created over 27,000 new federal regulations by thirty-two federal agencies impacting many industries (<a href=\"https:\/\/web.archive.org\/web\/20171209172338\/https:\/\/www.uschamber.com\/above-the-fold\/dodd-frank-s-regulatory-nightmare-one-rather-mesmerizing-illustration\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Dodd-Frank\u2019s Regulatory Nightmare in One Rather Mesmerizing Illustration<\/em><\/a>; uschamber.com).\u00a0 Compared to the previous Wall Street reform in 2002, which had two agencies issuing regulations to only five industries.\u00a0 Harrison stated that the Sarbanes-Oxley Act \u201c<em>basically sought more corporate transparency and accountability<\/em>.\u201d<\/p>\n<h2><strong>Many have associated Dodd-Frank with the <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2833961\" target=\"_blank\" rel=\"noopener noreferrer\">ongoing slow economic recovery<\/a>, citing increased consumer costs and restricted lending &#8211; which effects the housing market, home buyers and sellers.<\/strong><\/h2>\n<p>An example of increasing consumer costs is the CFPB\u2019s TILA-RESPA Integrated Disclosure.\u00a0 The Mortgage Bankers Association (mba.org) recently reported that <a href=\"https:\/\/newslink.mba.org\/servicing-newslink\/2016\/march\/servicing-newslink-3-29-16\/stratmor-trid-implementation-ups-lenders-origination-costs-by-210-per-loan\/\" target=\"_blank\" rel=\"noopener noreferrer\">compliance with TRID costs on average $210 per mortgage<\/a>, some of which is recouped from the consumer.\u00a0 The rule is also responsible for \u201cslower application to closing times.\u201d<\/p>\n<p>A <a href=\"http:\/\/dankrell.com\/blog\/2016\/10\/14\/liberty-housing-private-citizens\/\" target=\"_blank\" rel=\"noopener noreferrer\">recent appellate case<\/a> highlighted some of these Dodd-Frank outcomes.\u00a0 The CFPB sought fines against a mortgage lender for their years of compliance with HUD\u2019s interpretation of a rule; the fines were imposed retroactively for not complying with a new CFPB reinterpretation of the same rule.
