{"id":2787,"date":"2017-01-20T11:13:04","date_gmt":"2017-01-20T15:13:04","guid":{"rendered":"http:\/\/dankrell.com\/blog\/?p=2787"},"modified":"2021-11-23T16:46:45","modified_gmt":"2021-11-23T21:46:45","slug":"real-estate-legislation-2017","status":"publish","type":"post","link":"https:\/\/dankrell.com\/blog\/2017\/01\/20\/real-estate-legislation-2017\/","title":{"rendered":"Real estate legislation 2017"},"content":{"rendered":"<p>We are only two weeks into the New Year, but the <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=N1&amp;stab=01&amp;pid=broadsubjpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">Maryland General Assembly<\/a> has been busy.\u00a0 They have already introduced real estate legislation that affect <a href=\"http:\/\/dankrell.com\/blog\/2014\/11\/06\/how-home-buyer-and-sellers-have-changed-and-remained-the-same\/\" target=\"_blank\" rel=\"noopener noreferrer\">home owners<\/a>, <a href=\"http:\/\/dankrell.com\/blog\/2016\/07\/07\/5-home-buyer-life-hacks\/\" target=\"_blank\" rel=\"noopener noreferrer\">buyers<\/a>, <a href=\"http:\/\/dankrell.com\/blog\/2015\/08\/21\/regardless-of-investment-value-homeowners-do-better-than-renters\/\" target=\"_blank\" rel=\"noopener noreferrer\">renters<\/a>, and <a href=\"http:\/\/dankrell.com\/blog\/2014\/08\/28\/when-landlord-tenant-relations-go-wrong\/\" target=\"_blank\" rel=\"noopener noreferrer\">landlords<\/a>.\u00a0<strong> Surely there will be more real estate legislation proposed through the legislative session. Because these bills have a way to go before they are signed into law, you have an opportunity to voice your opinions to your State Representatives.<\/strong><\/p>\n<p>If you have a green thumb or you just like gardens, then <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=SB0062&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">Senate Bill 62 <em>Real Property \u2013Backyard Gardens\u2013Prohibition on Restrictions<\/em><\/a> should grab your attention.\u00a0 If you live in a single family home or townhouse, the bill provides for your right to have a backyard garden.\u00a0 The bill states \u201c<em>A contract, a deed, a covenant, a restriction, an instrument, a declaration, a rule, a bylaw, a lease agreement, a rental agreement, or any other document may not prohibit a homeowner or tenant from installing or cultivating a backyard garden on single\u2013family property.<\/em>\u201d<\/p>\n<p>If you\u2019re one of the many military personnel who rent in the area, pay attention to <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?pid=billpage&amp;stab=01&amp;id=sb0049&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">Senate Bill 49 <\/a><em>Landlord and Tenant \u2013 Military Personnel \u2013 Limitation on Liability for Rent.\u00a0 <\/em>The bill clarifies circumstances where active duty personnel and their spouses have limited liabilities on their leases.\u00a0 The statute previously refers to \u201cchange of station orders.\u201d\u00a0 However, the bill clarifies \u201cchange of assignment\u201d to include: \u201c<em>Permanent change of station orders; temporary duty orders for a period exceeding 90 days; orders requiring a person to move into quarters located on a military installation; and a release from active duty, including: retirement, separation or discharge under honorable conditions; and demobilization of an activated reservist or a member of the national guard who was serving on active duty orders for at least 180 consecutive days.\u201d<\/em><\/p>\n<p>If you live in a Common Ownership Community (co-op, condo or homeowners\u2019 association), consider these three bills (real estate legislation):<\/p>\n<p><a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0034&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 34 <\/a>amends the <em>Maryland Homeowners Association Act<\/em> by allowing a homeowners\u2019 association to charge \u201ca reasonable fee not to exceed $100\u201d to inspect your lot before you sell it.\u00a0 The lot may or may not have a home on it.\u00a0 Your homeowners\u2019 association may require a presale inspection of the exterior of your home as part of the process of preparing resale disclosures and documents.\u00a0 Many HOA\u2019s already conduct an exterior inspection of homes before a sale, alerting the seller and\/or the buyer of deficiencies that need to be corrected, so as to ensure the home complies with the association\u2019s rules and covenants.<\/p>\n<p><a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0041&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 41<\/a> requires common ownership communities to register with the State Department of Assessments and Taxation.\u00a0 The annual registration is to include the names and contact information of board members and property managers.\u00a0 Although the information may be useful to those who are renting or considering to purchase within a common ownership community, the bill indicates the registry is not a public record.<\/p>\n<p><a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0026&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 26<\/a> amends Real Property section 7-105.2 <em>Notice to record owner of property of proposed foreclosure sale; limitation of action.<\/em>\u00a0 The statute indicates that the owner of record be notified of a proposed foreclosure sale and\/or postponement of a foreclosure sale.\u00a0 The bill, however, requires that condo and homeowners\u2019 associations also be notified within thirty days of a proposed foreclosure sale within the community.\u00a0 And the associations shall be provided notice within fourteen days after a sale has been postponed. <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=SB0247&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">Senate Bill 247<\/a> is similar requiring the same notifications.<\/p>\n<p>Other real estate legislation so far relates to ground rents and foreclosures:<\/p>\n<p>Ground rents are in the spotlight again.\u00a0 <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0044&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 44<\/a> provides a ground lease registration form required with the ground lease holder&#8217;s contact information (name, phone number and even an email address) to be required by the State Department of Assessments and Taxation.\u00a0 <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0045&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 45<\/a> requires ground rent to be redeemed at time of property transfer or refinance.<\/p>\n<p><a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?id=HB0200&amp;stab=01&amp;pid=billpage&amp;tab=subject3&amp;ys=2017RS\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 200<\/a> increases the filing fee of a foreclosure of mortgage or deed of trust from $300 to $500.\u00a0 The fee is to be s distributed to the Housing Counseling and Foreclosure Mediation Fund.<\/p>\n<p>Copyright \u00a9 Dan Krell<br \/>\n<a href=\"https:\/\/plus.google.com\/101804958349854889493\">Google+<\/a><\/p>\n<p>If you like this post, do not copy;
