{"id":3450,"date":"2018-04-06T07:09:37","date_gmt":"2018-04-06T11:09:37","guid":{"rendered":"http:\/\/dankrell.com\/blog\/?p=3450"},"modified":"2021-11-23T17:21:20","modified_gmt":"2021-11-23T22:21:20","slug":"fair-housing-for-all","status":"publish","type":"post","link":"https:\/\/dankrell.com\/blog\/2018\/04\/06\/fair-housing-for-all\/","title":{"rendered":"Fair housing for all"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><a href=\"https:\/\/chicagorealtor.com\/april-fair-housing-month-heres-show-support\/\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/chicagorealtor.com\/wp-content\/uploads\/2017\/04\/fair-housing-poster-2017.jpg?resize=250%2C350&#038;ssl=1\" alt=\"fair housing\" width=\"250\" height=\"350\"\/><\/a><figcaption>Fair Housing (infographic from chicagorealtor.com)<\/figcaption><\/figure><\/div>\n\n\n\n<p>Title VIII of the Civil Rights Act of 1968, better known as the <a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Fair Housing Act<\/a> turns 50 this year.\u00a0 Title VIII was the culmination of a number of laws that focused on personal rights.\u00a0 Personal property rights are protected in <a rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/wex\/fifth_amendment\" target=\"_blank\">Fifth Amendment of the Constitution<\/a>.\u00a0 The <a rel=\"noopener noreferrer\" href=\"http:\/\/history.house.gov\/Historical-Highlights\/1851-1900\/The-Civil-Rights-Bill-of-1866\/\" target=\"_blank\">Civil Rights Act of 1866<\/a> was enacted to specify that all citizens, regardless of race or color, were equally protected under the law, which includes property rights.\u00a0 The <a rel=\"noopener noreferrer\" href=\"https:\/\/www.history.com\/topics\/black-history\/civil-rights-act\" target=\"_blank\">Civil Rights Act of 1964<\/a> prohibited discrimination based on race, color, religion, sex or national origin.\u00a0 The Fair Housing Act expanded the protected classes by prohibiting discrimination in the sale, rental and financing of dwellings based on race, color, national origin, religion, sex, disability and familial status (the presence of children).<\/p>\n\n\n\n<p>Some states and localities further expand the protected classes specified in the Fair Housing Act.&nbsp; For example, <a href=\"http:\/\/mccr.maryland.gov\/Pages\/Housing-Discrimination.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Maryland <\/a>protects fair housing regardless of race, color, religion, sex, familial status, national origin, marital status, sexual orientation, gender identity, or disability.&nbsp; <a href=\"https:\/\/www.montgomerycountymd.gov\/humanrights\/Resources\/Files\/fairhousinglaws.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Montgomery County<\/a> protects fair housing regardless of race, sex, marital status, physical or mental disability, color, religion, national origin, ancestry, presence of children, source of income, sexual orientation, age and family responsibilities.<\/p>\n\n\n\n<p>Some say we have come a long way in protecting fair housing rights.&nbsp; But have we?&nbsp; Even though we have come a long way to protect the rights for a number of groups, some still find it acceptable to discriminate against those who are not listed as a protected class.<\/p>\n\n\n\n<p>It was reported last week that a <a href=\"http:\/\/sacramento.cbslocal.com\/2018\/03\/28\/no-trump-buyers\/\" target=\"_blank\" rel=\"noopener noreferrer\">home seller in Sacramento CA<\/a> put her home for sale with the caveat to not sell to a Donald Trump supporter.&nbsp; Some legal experts say the home seller may run into a legal challenge based on the First Amendment.&nbsp; There are only a few states that include <a href=\"http:\/\/dankrell.com\/blog\/2016\/03\/10\/housing-and-presidential-election\/\">political affiliation<\/a>, activity, or opinion as a protected class against discrimination.&nbsp; California\u2019s Bane Civil Rights Act includes political affiliation as a protected class against violence or the threat of violence.<\/p>\n\n\n\n<p><a href=\"http:\/\/sacramento.cbslocal.com\/2018\/03\/28\/no-trump-buyers\/\" target=\"_blank\" rel=\"noopener noreferrer\">Drew Bollea<\/a> of CBS 13 of Sacramento (sacramento.cbslocal.com) reported that the home seller stated that she did not want to sell to a Trump supporter.&nbsp; And when it was pointed out that it could possibly narrow the buyer pool by 39 percent (39 percent of Sacramento voted for the President), she said that she did not care because her point was more important than money.&nbsp; She stated, \u201c<em>When you\u2019re talking about principles, ethics and morals, it runs very, very deep<\/em>.\u201d<\/p>\n\n\n\n<p>Principles, ethics and morals Indeed.&nbsp; Going back to the intentions of the Civil Rights Act of 1866, the spirit of the Fair Housing Act is <em>inclusion<\/em>.&nbsp; In today\u2019s politically divisive atmosphere, there are many who would agree with the Sacramento home seller\u2019s rationale of her discriminatory demand.&nbsp; However, her excuse proclaiming \u201cprinciple, ethics and morality\u201d harken back to the rationale of discriminatory practices of the past.<\/p>\n\n\n\n<p><a href=\"http:\/\/dankrell.com\/blog\/2007\/06\/06\/fair-housing-month-2007\/\" target=\"_blank\" rel=\"noopener noreferrer\">April<\/a> is National Fair Housing Month.&nbsp; It&#8217;s ironic that while <a href=\"https:\/\/web.archive.org\/web\/20210116204044\/https:\/\/www.whitehouse.gov\/presidential-actions\/president-donald-j-trump-proclaims-april-2018-national-fair-housing-month\/\" target=\"_blank\" rel=\"noopener noreferrer\">President Trump proclaimed<\/a> this year\u2019s Fair Housing Month recognizing the 50<sup>th<\/sup> anniversary of the enactment of the Fair Housing Act, those who voted for him are singled out.&nbsp; It appears there is still much work ahead for fair housing advocates.&nbsp; In his proclamation, President Trump urged \u201c<strong><em>all Americans to learn more about their rights and responsibilities under the Fair Housing Act and reaffirm their commitment to making homeownership within reach, no matter one\u2019s background<\/em><\/strong>.\u201d<\/p>\n\n\n\n<p>By Dan Krell<br \/>Copyright \u00a9 2018<\/p>\n\n\n\n<p>If you like this post, do not copy;
