Unless otherwise agreed to herein, all surface or wall mounted electronic components\/devices\u00a0do not convey\u2026<\/em>\u201d<\/p>\n\n\n\n<p>You\u2019ll notice that the disclosure specifically\nmentions wall mounted electronics and mounting brackets.&nbsp; This wording was added because new norms\nemerged with new technologies that created disputes about what was considered\n\u201cpermanently\u201d attached.&nbsp; As wall mounted\nTV\u2019s became commonplace, home buyers expected plasma TV\u2019s to convey and\nunsightly wall mounts to be removed.&nbsp; <\/p>\n\n\n\n<p>A more recent technology incorporated into a home that has become commonplace is the <a href=\"https:\/\/dankrell.com\/blog\/2014\/09\/05\/resurgence-of-solar-power\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"solar panel (opens in a new tab)\">solar panel<\/a>.\u00a0 Do they convey or not?\u00a0 Many home owners who install solar panels don\u2019t actually own them, they are leased.\u00a0 Of course, confusion and disputes regarding solar panels have occurred, and are now listed in the Lease Items and Service Contracts section. To help clarify what leased items convey and transfer, the <em>Inclusions\/Exclusions Disclosure <\/em>states: \u201c<em>Leased items\/systems or service contracts, including but not limited to: solar panels &amp; systems, appliances, fuel tanks, water treatment systems, lawn contracts, security system and\/or monitoring, and satellite contracts\u00a0do not convey\u00a0unless disclosed here\u2026\u201d<\/em><\/p>\n\n\n\n<p>It\u2019s not uncommon for a dispute to arise at the\nwalkthrough because the home seller decides to take a fixture or appliance that\nis not listed as an exclusion.&nbsp;\nRegardless whether the seller misunderstood or had a last-minute change\nof heart, the home buyer may be demanding the return of the item(s).&nbsp; And since the <em>Inclusions\/Exclusions Disclosure\nand Addendum<\/em> is part of the contract, the buyer may have recourse.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> Take it or leave it?<\/h3>\n\n\n\n<p>If you\u2019re <a href=\"https:\/\/dankrell.com\/blog\/2018\/02\/22\/home-selling-basics\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"selling your home (opens in a new tab)\">selling your home<\/a>, deciding to &#8220;take it or leave it&#8221; may be the last on your mind.
